Sampling and Quality Assurance
“The only prudent way to test the reliability of the keyword search is to perform some appropriate sampling of the documents determined to be privileged and those determined not to be in order to arrive at a comfort level that the categories are neither over-inclusive nor under-inclusive.” —Judge Paul Grimm
Building a Great Electronic Discovery Organization
There certainly are a lot of companies and law firms that claim to provide electronic discovery services, but how many good ones are there? What makes a good ediscovery service provider? What does it take to be a good ediscovery service provider and what does it take to move from merely good to great? Whether you are a new company thinking about moving into electronic discovery, an experienced company looking to improve your business, a law firm seeking to offer electronic discovery services, or a corporate counsel looking to take control of your ediscovery processes, the rules for building a great ediscovery organization are the same.
The risk of searching in ediscovery and what you can do about it
Unless steps are taken to reduce the costs of discovery, these costs threaten to overshadow the amount at issue in many cases and undermine the legal process. Many cases rely on keyword searches to limit the pool of potentially relevant documents. Some rely on keyword and name searches to identify potentially privileged documents. Although these processes may reduce the volume of documents to be reviewed, this reliance on simple search may be too risky for some situations. These searches cannot be guaranteed to produce the results you expect.
