The risk of searching in ediscovery and what you can do about it
by Herbert L. Roitblat, Ph.D.
Unless steps are taken to reduce the costs of discovery, these costs threaten to overshadow the amount at issue in many cases and undermine the legal process. Many cases rely on keyword searches to limit the pool of potentially relevant documents. Some rely on keyword and name searches to identify potentially privileged documents. Although these processes may reduce the volume of documents to be reviewed, this reliance on simple search may be too risky for some situations. These searches cannot be guaranteed to produce the results you expect.
